What ClarityAU is

ClarityAU helps people in Australia understand and organise their own property documents and property journey. It reads documents you upload, summarises what they contain, highlights dates, amounts and obligations, suggests questions you may want to ask, and keeps your property record in one place.

ClarityAU provides information and organisational assistance only. It is a tool, not a professional service.

ClarityAU is not a law firm, a solicitor, a conveyancer, a licensed real estate agent or a financial adviser, and does not provide legal, conveyancing, financial or tax advice.

Using ClarityAU does not create a solicitor-client, professional-client or fiduciary relationship of any kind. Nothing ClarityAU produces is a substitute for advice from a qualified professional about your circumstances.

You should obtain your own professional advice before signing, committing to, or relying on anything in a property transaction.

Automated analysis and its limits

Documents are processed automatically, including with artificial intelligence. There is no human review of your documents as part of the service.

Automated analysis can be incomplete or wrong. It can miss information, misread information, or summarise it in a way that does not reflect the full document.

Where a document is scanned or photographed, text is recovered using optical character recognition. Poor scans, handwriting, photographs, stamps, small print, tables and annexures may be read imperfectly or not at all. ClarityAU shows you when coverage of a document was incomplete, but you should always read the original document.

The original document always prevails over anything ClarityAU shows you about it.

Your responsibilities

You are responsible for the material you upload: that you are entitled to upload it, and that uploading it does not breach anyone else's rights or confidentiality.

You are responsible for checking anything important against the original document, and for seeking professional advice where it is appropriate.

You are responsible for keeping your account credentials secure and for activity that happens under your account.

Personal use only

Consumer plans are for your own or your household's property transaction. They may not be used to process documents for clients, customers, a portfolio business or other third parties.

Purchases, access periods and allowances

Plans are one-off purchases in Australian dollars. They do not renew automatically and no subscription is created.

Each plan states its access period, how many properties it covers and how many documents it can review. Those terms are fixed at the time you buy, so a later change to our prices or allowances does not change a plan you already hold.

A document only uses your allowance when its review completes successfully. Failures and retries never cost you a document.

When an access period ends, you keep your account and the structured information already produced. Processing new documents requires a current plan.

The price shown is the total amount you pay. Nothing is added at checkout. Payments are processed by our payment provider, which issues the payment receipt; ClarityAU never sees or stores your card details.

Refunds

Our Refund Policy explains how to ask us to investigate a refund, including for duplicate or incorrect charges and technical or service failures. Whether a change-of-mind refund is available may depend on whether the paid service has already been used.

Nothing in our Refund Policy or these terms limits rights or remedies that cannot be excluded under the Australian Consumer Law.

Your documents and how long they are kept

Original uploaded files are kept during your active access period and for 30 days after it ends, then deleted. Where there is no access period, an original is kept for 365 days from the date it was reviewed.

You can delete an original yourself at any time before that, and you can download it first.

When an original is deleted — by you or on schedule — the stored file, the working copies used during processing and the extracted page text are removed. The structured information already produced stays in your account: summaries, key dates, amounts, obligations, questions, checklists and your property record.

Routine encrypted backups are kept separately and roll off on their own cycle, up to 30 days.

Availability

ClarityAU is provided on an ongoing best-efforts basis. It may be unavailable at times for maintenance, upgrades or reasons outside our control, and features may change.

Acceptable use

You must not:

  • upload material you are not entitled to upload
  • use ClarityAU to provide legal, conveyancing or advisory services to other people
  • attempt to access another person's account, documents or information
  • interfere with, overload, probe or reverse engineer the service
  • scrape, resell or redistribute ClarityAU's output as your own product

Intellectual property

You keep ownership of the documents you upload. You grant ClarityAU permission to process and store them only so far as is needed to provide the service to you.

ClarityAU owns the software, interface, wording, checklists and journey content. You may use the output for your own property matter, but not republish or resell it.

Your account

You need an account to use paid features. You can ask us to close your account from the account page at any time. Some records — payment records, and security and audit records — must be kept for legal, tax and dispute purposes even after closure.

Your Australian Consumer Law rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded.

Where the Australian Consumer Law applies, you may be entitled to a remedy for a major failure and to compensation for reasonably foreseeable loss or damage.

Liability

Subject to your Australian Consumer Law rights above, and to the extent the law allows, ClarityAU is not liable for decisions you make in a property transaction, for anything an automated review misses or misstates, or for loss that was not reasonably foreseeable.

These terms do not give ClarityAU absolute protection, and they are not intended to. They set out how the service works and what it is not.

Governing law

These terms are governed by the law of Australia and the Australian state or territory in which ClarityAU operates. You and ClarityAU submit to the courts of that place.
